Calling Compliance for Real Estate

40 min

For every Narqix team member who calls, texts or markets on a US real estate campaign. After this page you will know the rules behind every Narqix calling standard, and the exact actions that keep sellers, clients and Narqix safe.

Track: Real Estate · Role: All roles · Time to complete: 40 min

Not legal advice. This page explains Narqix operating standards and summarises US rules as researched in October 2026. Telemarketing and wholesaling laws change often. Our clients are responsible for their own legal compliance and must confirm current rules with their own US counsel. When this page and your client's written instructions differ, follow the stricter one and tell your team lead.

Why this matters

US calling laws allow people to sue for each illegal call or text. Damages can be USD 500 per call or text, and up to USD 1,500 if the violation is willful. A single list dialed the wrong way can create thousands of violations. Clients choose Narqix because our teams make compliance a habit, not an afterthought.

The Narqix principle is simple: when a rule is unclear, we act as if the strictest version applies. For example, some courts have said a pure offer to buy a house is not a "telephone solicitation", but this is unsettled and varies by state. Narqix scrubs and complies as if all seller outreach is covered.

The ten Narqix compliance rules

  1. Scrub every list before outreach: National Do Not Call Registry (refreshed at least every 31 days), state lists, the internal do-not-call list and known litigator lists. Log the scrub date.
  2. Call only inside the window: Narqix default 9 AM to 8 PM in the owner's local time, Monday to Saturday, no Sundays or US federal holidays, plus stricter state rules.
  3. Maximum 3 attempts per owner in 24 hours, across every number and channel combined.
  4. Disclose recording at the start of every call, in every state.
  5. Identify yourself and the business at the start of every call and in the first text.
  6. Stop means stop: any opt-out, in any words, goes on the internal do-not-call list immediately, across every client and campaign.
  7. No prerecorded voice, AI voice or ringless voicemail to owners without prior written consent.
  8. Texts only through a registered campaign under the client's business, only to permitted recipients, with opt-out language.
  9. Honest caller ID only: client-owned US numbers through the client's US calling system. No spoofing, no personal or foreign numbers.
  10. Escalate legal threats the same day.
  • Calls or texts to mobile phones using an automatic dialing system, or using an artificial or prerecorded voice, require the owner's prior express consent. For marketing, that means prior express written consent.
  • AI-generated or cloned voices count as artificial voices under US rules (since February 2024). They need the same consent as prerecorded calls.
  • A federal rule that would have required separate consent for each seller ("one-to-one consent") was struck down by a court in January 2025 and later removed. Some guides still describe it as coming into effect; that is out of date. Clients and lead vendors may still require seller-specific consent in their contracts.

National Do Not Call Registry

  • Telephone sales calls to numbers on the national registry need consent or an existing business relationship.
  • Lists must be scrubbed against the registry at least every 31 days and before every campaign.
  • A written do-not-call policy, training, scrubbing and records help protect the client if a claim is made. Narqix keeps all four.

State do-not-call lists

Some states run their own lists (Texas is one example). The data team scrubs against them where they exist.

Internal (company) do-not-call list

  • Every request to stop is added to the internal list.
  • US rules require it to be honored within 10 business days. Narqix does it immediately.
  • Records are kept for at least 5 years (and at least 10 years for Virginia numbers).
  • An opt-out given on any Narqix campaign is honored for that number across all Narqix campaigns.

Coach's note: People rarely say "Please add me to your internal do-not-call list." They say "Don't call me again," "Take me off," "I'm not interested, stop," or simply hang up after "remove my number." All of these are stop requests. When in doubt, it is DNC.

Calling hours

Always use the stricter of federal and state law, in the owner's local time. Gate by both the phone's area code and the property or mailing address, because people keep their numbers when they move.

AreaPermitted windowExtra limits
Federal rule8 AM to 9 PMNone beyond the general rules
Narqix default9 AM to 8 PM, Monday to SaturdayNo Sundays or US federal holidays. Max 3 attempts per 24 hours.
Florida8 AM to 8 PM3 calls per 24 hours on the same subject; written consent for automated dialing, texts and voicemails
Oklahoma8 AM to 8 PM3 per 24 hours; written consent for automated selection or dialing; caller ID rules
Maryland8 AM to 8 PM3 per 24 hours; written consent for automated selection or dialing
Washington8 AM to 8 PMCommercial robocalls banned; marketing texts need prior consent; identify within 30 seconds
Texas9 AM to 9 PM Monday to Saturday; noon to 9 PM SundayTexts now count as telephone solicitations; registration may be required unless exempt
Connecticut9 AM to 8 PMIdentify within 10 seconds
Rhode Island9 AM to 6 PM weekdays; Saturday ends earlier (use 5 PM)No Sundays or holidays
Alabama, Louisiana, Mississippi, Utah8 AM to 8 PM (AL, LA)No Sunday or holiday sales calls (Louisiana also includes Mardi Gras and Good Friday)
Minnesota9 AM to 9 PMNone extra listed
Oregon8 AM to 8 PMNone extra listed
Virginia8 AM to 9 PMTexts covered; opt-outs honored for at least 10 years
New York8 AM to 9 PMIdentify yourself and offer do-not-call within 30 seconds

The Narqix default window satisfies nearly every state. Two exceptions still need state gating: Rhode Island (calls end at 6 PM on weekdays and earlier on Saturday) and Texas (keep the 9 AM start; Narqix still does not call on Sundays).

Call recording disclosure

  • In all-party consent states, everyone on the call must agree to recording: California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Oregon, Pennsylvania and Washington. Michigan is often described as unclear.
  • When the caller and owner are in different states, the strictest rule applies.
  • Narqix rule: announce recording on every call in every state, near the start, in plain words. For example: "Just so you know, this call may be recorded for quality."
  • Quality reviewers listen to recordings only inside the client's systems. Never download recordings to a personal device.

Opt-outs (calls and texts)

  • Owners may opt out by any reasonable means: saying it on a call, replying to a text, emailing, or anything else that clearly shows they want contact to stop.
  • Replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL or UNSUBSCRIBE always counts as an opt-out.
  • US rules require opt-outs to be honored within 10 business days. A proposal to shorten this to 7 business days was under review in late 2026. Narqix honors every opt-out immediately.
  • A new federal order adopted in autumn 2026 allows callers to name specific opt-out methods if they disclose them clearly. It takes effect 30 days after official publication; check current status with your team lead. Texters must still honor all seven keywords, and any opt-out from marketing stops all marketing calls and texts.
  • Send at most one confirmation message after a text opt-out (if your campaign uses one). Then no further contact.
  • Florida allows one confirmation text after STOP. Virginia requires STOP or UNSUBSCRIBE requests to be honored for at least 10 years.

Never do this: Never try to "save" an opt-out ("Before you go, can I just ask..."). Never contact an opted-out owner from another number, another client campaign, or another channel. Never delete or edit a do-not-call record.

Caller ID honesty

  • Showing a misleading or false caller ID to defraud or cause harm is illegal, and this explicitly covers callers outside the US calling US numbers, and texts.
  • Oklahoma also bars displaying a deliberately different number.
  • Narqix rule: dial only through the client's US calling system, using client-owned or leased US numbers registered to the client. Never use personal SIM cards, foreign internet calling numbers, or "local presence" numbers the client does not control.
  • Flagged numbers are retired properly through the client, not rapidly rotated to dodge spam labels.
  • Proposals in 2025 and 2026 would label foreign-originated calls and tighten caller verification. Keeping all calls on US infrastructure prepares the client for these.

Texting registration and rules

  • Since February 2025, US carriers block business texts from local numbers that are not registered (the system is commonly called A2P 10DLC).
  • Registration needs the business's legal name, tax ID and address exactly as on US tax records, a live website, sample messages, a public opt-in page with clear consent wording, a privacy policy that covers texting, and STOP and HELP handling.
  • Every client's texting campaign is registered under the client's own business details, never Narqix's.
  • Carriers have pushed real estate texting platforms to stop mass cold texting. Texting cold, non-consented lists risks blocking, suspension and lawsuits in several states.
  • Narqix default: texts go to consented or engaged owners, or to owners who agreed during a live call to receive texts.
  • Message hygiene: identify the business in the first text, include opt-out language, never text outside the window, maximum 3 touches per 24 hours, and watch for opt-outs written in normal words.
  • Courts disagree on whether texts count as "calls" for do-not-call purposes. Narqix treats texts as covered.

Dialers and voicemail

  • Predictive dialers must keep abandoned calls at 3% or less per campaign over 30 days, connect a live agent within 2 seconds of the greeting, and let a phone ring at least 15 seconds or 4 rings. A proposal to remove these rules has not become final.
  • Narqix preference: agent-started power or multi-line dialing with live agents. Prerecorded voicemail drops only where written consent exists.

Warning signs of a possible lawsuit

Some people collect calling violations to sue. Escalate the same day (code LIT-FLAG, add to the internal do-not-call list) when someone:

  • Asks if the call is recorded in a confrontational way, then asks for your company's full legal name and address.
  • Asks for a copy of your do-not-call policy.
  • Says they are on the do-not-call list and asks how many times you have called.
  • Mentions lawyers, lawsuits, regulators or the law by name.

Stay polite, do not argue, do not admit anything, give only your name and the company name, end the call politely, and report.

State wholesaling laws

Wholesaling (contracting a property and assigning the contract for a fee) is now regulated in a growing number of states. Rules cover licensing, written disclosures, cancellation rights, marketing and recording. This table is a training summary only. Confirm every item with the client's counsel and title company before relying on it.

Confirm with client counsel. Some popular online tables are out of date (one widely read page in 2026 still showed Pennsylvania as needing no license). Use only your client's counsel, the title company and official sources. Before any contract is countersigned, complete the client's Market Compliance Card for the state: license or registration, disclosure and timing, cancellation window, marketing permission, and recording rules.

Your pre-dial checklist

  • The list was scrubbed (national within 31 days, state, internal, litigator) and the date is logged.
  • The dialer is gated to the strictest window and blocks Sundays and holidays.
  • No more than 3 attempts per owner per 24 hours.
  • I will say my name, the business name and the recording disclosure on every call.
  • I will code every stop request DNC immediately.
  • No prerecorded or AI voice, no ringless voicemail, without written consent.
  • Texts only through the client's registered campaign, to permitted recipients, with opt-out language.
  • No spoofed, personal or foreign caller IDs.
  • Legal threats escalated the same day.
